Zora Terms of Service

The following document outlines the terms of use of the Zora Web site and Application. Before using any of the Zora's services, you are required to read, understand, and agree to these terms. The column on the right provides a short explanation of the terms of use and is not legally binding.




Legally,

1.) By using the Zora.io website and Zora service (the "Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service"). We have done our best to make our terms clear, concise and easy to understand.

  Basically,

by using Zora you agree to all the terms bellow, for all existing features and functionalities.

 
2.) The Service allows landlords to set up online rental applications for their properties, communicate with tenants and rental applicants as well as screen potential tenants.

The Service also allows potential tenants to submit rental applications and to make online rent payments and, at the request of landlords, order and share personal reports. More services are coming soon for both landlords and tenants.
 

We make the renting process easier for landlords and tenants.

You can opt out of them at any time and any data or information that you provide us will be kept secure and private.


 
3.) Zora is currently free for both landlords and tenants. We also have a “Pro” subscription plan with a monthly fee.

If we change our fees or offer new features that have additional fees, we will inform you in advance via email or on the Zora web-site.

If you do not want to pay the new fees, you can cancel service anytime. There will be no refunds for fees you have already paid.
 

We currently offer a free and Pro account. If our pricing model changes in the future we will let you know before you are charged.

You can opt out at any point. However, no refunds will be provided for services that you have already paid for.


 
4.) By providing us with your banking or other payment information, you authorize us to use it and disclose it vetted payment gateway providers for the purpose of processing the payments you authorize on the Service.

Payment gateway providers may also aggregate your information for other purposes, but only in ways that don’t identify you personally or disclose any personal information about you, and may disclose your personal information when necessary to comply with the law.

If a payor or payor’s bank initiates a reversal, chargeback, or dispute of a payment made to you, you authorize us and our third-party payment providers to reverse or otherwise debit funds from your account in accordance with applicable financial institution and network policies and procedures.

We may also initiate a reversal or other debit, or take other actions we determine to be appropriate, if we believe fraud or other abuse of the Service has occurred.
 

If you provide us with your banking information for rental payments, this gives us permission to use it.

All your information will be anonymized.

Any payment mistakes made between us (Zora), our payment gateway, and your bank will be handled by us.
All funds/moneys will be returned in full for any errors made.


 
5.) Zora allows landlords to view a tenant quality report from prospective tenants using the Service in a form of a numeric quality score (Z score), background and reference checks.

Zora also allows prospective tenants to proactively obtain a Z score. We also give prospective tenant the right to share their application with other landlords.

To provide this portion of the Service, we may ask prospective tenants for their Social Security Number (or Social Insurance Number, if in Canada) and other personally identifying information (such as information about other creditors you have had), which we will share with our third-party data sources for the purposes of preparing and sharing reports and verifying your identity, and which we will not store (except than on a temporary basis) or use for any other purpose.
 

Zora provides background reports on tenants to help speed up the application process.

We use two main things to provide a background check; references (employers + past landlords) and the Z score (an algorithm that assesses a tenant’s riskiness).

We do not guarantee the results of these reports. They are not designed to replace common sense or practical judgement.


 
6.) We use third-party identity verification services to help ensure that users are who they say they are prior to enabling certain features of the Services, such as electronic payments and the ordering and requesting of background checks.

Once your identity has been verified, we may also display a badge or other visual indicator to let other users know that you’ve successfully completed the identity verification process. However, we neither control nor guarantee the accuracy of any identity verification service (and none can prevent all scams), so you should always take the same precautions in dealing with others through our site that you would in person.
  We do our best to verify a tenant’s identity for you. However, we do not guarantee that we are right and haven’t made a mistake.

 
7.) We are not a real estate agent or broker. We don’t screen properties or listings or offer any guaranty or advice regarding the suitability of properties, landlords, or potential tenants.

Nothing we say should be construed as such advice, and you agree not to rely on us in making decisions on anything at all.
 

Zora isn’t a cop-out or replacement from using common sense when going through the rental process for either landlords or tenants.

Think of us as a trusty sidekick.


 
8.) Zora’s tenant selection and confirmation features are designed to make communication between landlords and prospective tenants easier; neither they nor any other aspect of the Services are intended to create any kind of contract or other legal obligation between a landlord and a prospective tenant (or between anyone else, for that matter).

Just like in the offline world, you should wait until a written rental or lease agreement is signed by both the landlord and tenant before relying on any tenancy you arrange using Zora.
 

Zora is not a guarantee of a rental agreement.

A tenant and a landlord are still required to sign a lease.


 
9.) You must be at least 18 years old to use Zora and you must be a resident of United States, Canada or European Union.  

We currently only handle the United States, Canada and the EU. You’re out of luck for now if you live elsewhere - Sorry!


 
10.) You must be a human.

Accounts registered by “bots” or automated methods of access are not permitted.

No screen-scraping, reproducing, or aggregating the information or other content you see on our site.
  This site is for humans only. Stay away Skynet, you’re not welcome here.

 
11.) Use of the Service does not give you ownership of any intellectual property rights in the Service or any content posted on the Service.

You own what you post on the Service, but you grant us a license to copy, host, display, create derivative works from, publish, publicly perform, display, and distribute, and otherwise make use of in connection with providing the Service, all information and content you post so long as you have an active account.
 

You do not have a right to any of our intellectual property just because you are a Zora user.

We have the right to store all of your information as long as you have any active account.



 
12.) You must provide your full legal name, a valid email address, and any other information requested in order to complete the signup process.

You are also responsible for keeping your email address up to date, so we can send you important notices.
 

You’re a real person, use your actual name please.

If any of your information changes please update your profile.


 
13.) Your account may only be used by one person.

A single account shared by more than one person is not permitted.
  One person, one account. Got it?

 
14.) You are responsible for keeping your password and account secure as well as changing your password once in a while, in accordance with the best-practices of online safety.   Change your password regularly to keep your account safe. Use best practises for online safety.

 
15.) You are responsible for the accuracy of everything that is posted or submitted under your account.   Come on, this one’s pretty straightforward. Just read it.

 
16.) We are not responsible for the accuracy of anything another user posts or submits to our site.   We are not responsible for anything that our users post while using Zora.

 
17.) We are not responsible for the conduct of users on or off the site. Use common sense when doing business with other users.   We are not responsible for anything that a user does on our site or off of it.

 
18.) You may not use the Service for any illegal purpose.

You may not, in using the Service, violate any laws in your jurisdiction or ours, or infringe the rights of anyone (ours or third parties). We’d like to think this goes without saying, but you may not use the Service as part of any fraudulent scheme or transaction.

If we have reason to suspect your account has been used for an unauthorized or illegal purpose, you agree that we may share information about you, your account, and any of your transactions with law enforcement.
  Don’t do anything illegal in conjunction with Zora.

If we suspect that you have committed an illegal act we have the right to share your information with the proper authorities.

 
19.) If you are a landlord, you agree in particular that you are familiar with all applicable fair-housing and antidiscrimination laws and that you will adhere to them.   Follow local laws when it comes to renting your property.

 
20.) You may not abuse, harass, threaten, impersonate, or intimidate other Zora customers. Ever.   Don’t be a jerk.

 
21.) If you violate any of the Terms of Service, we may terminate your account without notice.   If you break your terms of service we can terminate your account.

 
22.) We reserve the right to modify or terminate the Service for any reason, without notice, at any time.   Things change, we sometimes need to update our Terms of Service.

If we do, these will be the new rules moving forward.

 
23.) We reserve the right to alter these Terms of Service at any time.

We’ll notify you on the site or via email of important changes, but you should also check back here from time to time if you care about "legalise"
  We’ll notify if we change the Terms of Service via the email that you have provided us.

However, sometimes our emails might end up in your spam folder so check back here once in awhile just in case as well.

 
24.) You’re free to cancel or discontinue using the Service at any time without penalty.

Your continued use of the Service following a change to these Terms of Service constitutes acceptance of the change.
  If we change the rules and you continue using the product after seeing the new rules - you agree to the new rules.

 
25.) If we change our pricing, we will give you at least 30 days of notice, via the site or email.   We’ll notify you at least 30 days before we up the price on you (or charge you less :)

 
26.) We reserve the right to refuse service to anyone for any reason (or without official reason), and likewise to suspend or discontinue your use of the Service at any time for any reason or no reason.

For example, we may terminate or suspend your account if you engage in fraudulent or illegal conduct, provide inaccurate, incomplete, false, or misleading information, or otherwise violate these Terms of Service or any of our policies, or if we determine, in our sole discretion, that your use of the Services poses an unacceptable credit or fraud risk to us.
  We have the right to cancel your account or refuse you service at any time without explanation.

 
27.) If you wish to cancel your account, you must do so via the Service web site or by sending us an email (or a phone call to our support line).   You can cancel your account in a bunch of ways; using our website, by email, or by calling us.

 
28.) If you cancel your account, any or all of your information may be immediately (or at some point in the future) irrevocably deleted. You should save a copy of anything important before cancelling your account.   If you have cancelled your account we are going to delete the information that you’ve stored on Zora at some point. If it’s important make sure to save it somewhere else.

 
29.) Information you post or otherwise furnish to us, including personal information, may remain on our servers indefinitely (for example, as backups) after you delete it from public areas of the Services or request cancellation of your account.   We have the right to keep some or part of your information stored on our services indefinitely. (ie. until Judgement Day. See Terms of Service point 12.

 
30.) If you are a landlord, you agree to indemnify, defend, and hold harmless us and our affiliates, agents, officers, employees, and vendors (including without limitation our third-party credit reporting agencies and their respective affiliates, agents, officers, and employees) from any claim, suit, action, or loss arising from or relating to your use of the Service or your violation of these Terms of Service (collectively, any “Claim”), including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorney's’ fees.   We aren’t responsible if something goes wrong. And that means anything.

You waive the right to sue us our any of our affiliates. Ever.

 
31.) If you are a landlord, by requesting or viewing a background report using the Service, you additionally represent and warrant the following: (1) that you have never been involved, and will not become involved, in any fraud or other unethical business practice and that you will immediately discontinue all use of the Service (and any reports and other information obtained via the Service) and notify us if you are ever involved in any such fraud or practice; (2) that your request for any background report using the Service, and your use of any background report obtained through the Service, is lawful and solely for the purpose of evaluating a prospective tenant’s rental application; and (3) that you will not provide a copy of any report obtained through Zora, or any information contained in such a report, to any other party.

You agree to indemnify, defend, and hold harmless us and our affiliates, agents, officers, employees, and vendors (including without limitation our third-party credit reporting agencies and their respective affiliates, agents, officers, and employees) from any Claim arising out of or relating to your breach of the foregoing representations and warranties.
 

A person’s personal information is sacred.

You will only use the information provided on their background report to review their potential as a tenant.

You will not use the background report for fraudulent purposes, or share their personal information with any other third-parties.


 
32.) THE SERVICE IS PROVIDED “AS-IS” WITHOUT PROMISES OF ANY KIND. NEITHER WE NOR OUR SUPPLIERS WARRANT OR GUARANTEE UPTIME OR AVAILABILITY OF THE SERVICE, THAT THE SERVICE WILL MEET OR CONTINUE IN THE FUTURE TO MEET YOUR NEEDS, OR THAT WE WILL CONTINUE TO PROVIDE THE SERVICE OR ANY ASPECT OF THE SERVICE IN THE FUTURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES FOR THE SERVICE, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SEAWORTHINESS, AND NON-INFRINGEMENT.
  Things can change at any time.

We don’t guarantee that our service will be here in the future, nor anything else that can thus be inferred (ie. running reports, tenant verification, data storage etc.)

 
33.) TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES, OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES OR THESE TERMS OF USE, INCLUDING ANY CLAIM FOR ANY IMPLIED WARRANTY, IS LIMITED TO THE AMOUNT YOU PAID TO US TO USE THE SERVICES.   If things go south and you decided to sue us. The maximum amount that you agree to go after us for is the total amount that you have so far paid for our service.

 
34.) If you violate any of these Terms of Service and we don’t take action right away, that doesn’t mean we are waiving any of our rights. If you want to sue us, you must do so in the Provincial Courts located in Halifax, Nova Scotia, and you consent to personal jurisdiction in those courts. Nova Scotia law (excluding Nova Scotia’s conflict of laws rules) will apply to any such disputes.

If any part of these Terms of Service are held to be invalid or enforceable, the rest of the Terms of Service will still apply.
  If you’re really mad at us and decide to take legal action against us - we’d prefer you didn’t but still you agree to do it in Halifax, Nova Scotia.
